Terms of Use
Agreement
By installing or using MediSens you agree to these terms. If you do not agree you must not use the software.
What MediSens is
MediSens is clinical decision support software for healthcare professionals. It summarises information, interprets results, suggests actions, and links patients to support tools. It does not replace clinical judgment.
No medical advice
All outputs are informational. They are not a diagnosis or a prescription. You remain responsible for your clinical decisions and for confirming information against current guidelines, formularies, product information, and the patient record.
Professional responsibility
You agree to apply your own clinical judgment. You agree to verify recommendations, check contraindications and interactions, and obtain informed consent where required.
Not for emergencies
Do not use MediSens for emergencies or life threatening conditions. Use standard emergency protocols and services.
Accuracy and availability
MediSens may contain errors or be unavailable. Clinical content, guidelines, formularies, and product information change over time. You agree to check primary sources before acting.
Third party content
MediSens may link to third party services such as WhatsApp support programs, pathology providers, or pharmaceutical information. We are not responsible for third party content or services.
Integrated Partners laboratories, pharmaceutical companies, medical scheme formularies
Acceptable use
You will not use MediSens for unlawful purposes or to bypass clinical governance. You are responsible for all activity under your account and for the security of your devices and credentials.
Indemnity
You agree to indemnify and hold harmless the company and its directors, employees, contractors, and partners from any claim, loss, liability, penalty, fine, cost, or expense including reasonable legal fees that arises from your use of MediSens. This includes claims linked to reliance on any output, incorrect or incomplete information, configuration or integration errors, breach of these terms, breach of law or regulation, or misuse by you or any person using your access.
Limitation of liability
To the maximum extent allowed by South African law the company is not liable for indirect or consequential loss. Direct damages are limited to the amount you paid in the twelve months before the event that gave rise to the claim or to one thousand rand if the software is used free of charge.
No warranties
MediSens is provided as is and as available. We disclaim all warranties whether express or implied including fitness for a particular purpose and non infringement.
Intellectual property
All rights in the software, models, content, and trademarks remain with the company or its licensors. You receive a limited revocable and non transferable licence to use the software for clinical decision support in your practice.
Updates and beta features
We may update features and content without notice. First adopter and beta features are in development and may change or be withdrawn.
Fees
Where features are free we may later offer paid plans. We will communicate pricing before any charges begin.
Suspension and termination
We may suspend or end access for breach of these terms, suspected misuse, legal risk, or security risk. You may stop using the software at any time.
Governing law and disputes
These terms are governed by the laws of the Republic of South Africa. Disputes will be resolved in the courts of South Africa. You agree to good faith negotiation before litigation.
Privacy Policy
Our commitment
We take privacy and security seriously and will protect data in line with applicable laws and industry standards.
🇿🇦 South African Data Residency
All data is stored on servers located within the Republic of South Africa. Your data does not leave South African borders and is subject to South African data protection laws including the POPI Act.
Information we collect
When you use MediSens you may submit personal information about patients such as names identification numbers and test results as part of medical queries.
You may also provide user account details such as your name email and organisation to manage access.
We do not collect unnecessary personal data.
Data categories collected:
- Professional Information: Healthcare provider details, practice information, professional registration
- Clinical Data: Patient information for decision support (pathology results, clinical queries)
- Usage Information: Application interaction data, features accessed, usage patterns
- Technical Information: Device details, operating system, performance metrics
How we use information
We process submitted data only to:
- Provide AI generated medical report suggestions and insights
- Improve accuracy and reliability using de identified and aggregated data only
- Ensure compliance with security auditing and legal requirements
- Deliver clinical decision support and access to guidelines and formularies
- Enable patient support journey connections (with consent)
- Provide customer support and service updates
We do not sell or share data for marketing.
Data security
We protect your data using industry-leading security measures:
- Encryption in transit: TLS (Transport Layer Security, minimum version 1.2)
- Encryption at rest: AES 256 or equivalent
- Access controls: Restricted to authorised personnel only, with immutable audit trails
- Security standards: Systems and processes aligned with ISO IEC 27001 information security standards
- Regular audits: Security vulnerability assessments and penetration testing
- Incident response: Breach notification procedures in accordance with POPI Act
- Staff training: Ongoing data protection and security awareness
Data storage and retention
All data is stored securely in the stated hosting region or country to be confirmed with you in writing.
Patient related data is retained only as long as needed to provide the service or as required by law.
You may request deletion of data through our support channels and we will respond within a reasonable period.
Note: Clinical data may be retained longer to comply with healthcare record-keeping requirements and regulatory obligations.
Sharing of information
We do not share identifiable personal information with third parties except where required by law or court order or where you authorise a connection to other systems such as practice tools or messaging services.
Limited sharing circumstances:
- Service Providers: Trusted third-party providers operating within South Africa, bound by strict confidentiality
- Legal Requirements: When required by South African law or legal process
- Healthcare Partners: Laboratory partners, pharmaceutical companies with your consent and authorization
- Patient Communication: WhatsApp for patient support journeys, only with explicit patient consent
⚠️ Your data is never transferred outside of South Africa without explicit consent.
Your responsibilities
You must ensure that any personal data you submit complies with privacy laws that apply to you. These include POPIA in South Africa and where relevant GDPR or HIPAA. You are responsible for obtaining patient consent where the law requires it.
Your rights
You may request access correction or deletion of your personal information that we hold. We will act on requests as required by law and will notify you when the request is complete.

- Request deletion of your personal information (subject to legal obligations)
- Object to processing of your personal information
- Request restriction of processing
- Withdraw consent where processing is based on consent
- Lodge a complaint with the Information Regulator
Children
MediSens is intended for use by healthcare professionals. It is not directed at children.
Changes to this policy
We may update this policy from time to time. Changes will be posted in the app and on our website. Continued use after an update means you accept the revised policy.

MediSens is a clinical decision support tool and does not replace your professional judgment as a healthcare professional. All clinical decisions and patient care responsibilities remain solely with you as the healthcare professional. You must verify all recommendations against current clinical guidelines and the patient record.

By using MediSens, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and Privacy Policy. You confirm that you are a licensed healthcare professional and will use the software in accordance with applicable laws and regulations.
🔒 Compliance Standards
MediSens maintains compliance with the Protection of Personal Information Act (POPI Act) and aligns with ISO 27001 (Information Security Management), ISO 42001 (Artificial Intelligence Management System) and ISO 27701 (Privacy Information Management) standards. All processing is governed by South African law.
